TERMS OF SERVICE, LIABILITY WAIVER & ASSUMPTION OF RISK

1. ACCEPTANCE OF TERMS By purchasing products from Temp Drop Labs ("we," "us," "our"), you ("the Customer") agree to be bound by these Terms of Service, Liability Waiver, and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this site or purchasing our products.

2. NATURE OF PRODUCT (DIY KIT) The Customer acknowledges that the "Cold Plunge Kit" sold by Temp Drop Labs is a Do-It-Yourself (DIY) assembly kit.

  • Temp Drop Labs provides components (pump, tubing, fittings) and facilitates the sale of third-party equipment (chiller, tub).
  • Assembly Required: The Customer is solely responsible for the correct assembly, installation, and maintenance of the product. Temp Drop Labs is not responsible for improper installation, loose fittings, or failure to follow instructions.

3. ELECTRICAL & WATER SAFETY WARNING DANGER: This product involves the combination of water and electricity. Improper setup can result in SERIOUS INJURY, ELECTRIC SHOCK, OR DEATH.

  • GFCI Requirement: The Customer agrees to ONLY plug the chiller and pump into a Ground Fault Circuit Interrupter (GFCI) protected outlet. If you do not have a GFCI outlet, you must install one or use a portable GFCI adapter.
  • Dry Zone: The Customer agrees to keep the chiller unit and all electrical connections in a dry area, away from splashing water.
  • Liability: Temp Drop Labs assumes NO LIABILITY for electrical accidents, shocks, or fires caused by the user’s failure to follow safety protocols or use proper electrical outlets.

4. HEALTH & MEDICAL DISCLAIMER Cold water immersion places significant stress on the body.

  • Consult a Doctor: You should consult a physician before beginning any cold exposure regimen, especially if you have a history of heart disease, high blood pressure, diabetes, or are pregnant.
  • Hypothermia/Drowning: Users should never plunge alone or under the influence of drugs or alcohol. Users acknowledge the risk of hypothermia and loss of consciousness.
  • By purchasing this product, the Customer affirms they are in good physical health and assumes all risks associated with cold water exposure.

5. SPLIT SHIPPING & FULFILLMENT POLICY To provide the best possible pricing, our kits operate on a Multi-Shipment Fulfillment Model. The Customer acknowledges that their order will arrive in three (3) separate packages, likely on different days:

  1. Shipment A (The Connection Kit): The pump, tubing, and fittings are shipped from our US facility. (Typical transit: 3–5 business days).
  2. Shipment B (The Chiller): Ships directly from our manufacturing partner. (Typical transit: 5–15 business days).
  3. Shipment C (The Tub): Ships directly from our manufacturing partner. (Typical transit: 5–15 business days).

Important: You will receive separate tracking numbers for each shipment. The arrival of one component (e.g., the Tub) before the others (e.g., the Chiller) is normal and does not constitute a missing order.

6. RELEASE OF LIABILITY & INDEMNIFICATION TO THE FULLEST EXTENT PERMITTED BY LAW, THE CUSTOMER HEREBY RELEASES, WAIVES, AND DISCHARGES TEMP DROP LABS, ITS OWNERS, EMPLOYEES, AND SUPPLIERS FROM ANY AND ALL LIABILITY, CLAIMS, DEMANDS, OR CAUSES OF ACTION ARISING OUT OF OR RELATED TO:

  1. ANY INJURY, ILLNESS, PARALYSIS, OR DEATH ARISING FROM USE OF THE COLD PLUNGE.
  2. ANY PROPERTY DAMAGE (INCLUDING WATER DAMAGE TO FLOORS, WALLS, OR ELECTRONICS) CAUSED BY LEAKS, OVERFLOWS, OR COMPONENT FAILURE.

The Customer agrees to indemnify and hold harmless Temp Drop Labs against any claims made by third parties (e.g., family members or guests) who use the product assembled by the Customer.

7. LIMITATION OF LIABILITY IN NO EVENT SHALL TEMP DROP LABS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE PRODUCTS SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE PRODUCT.

8. WARRANTY & RETURNS

  • Connection Kit (Pump/Hoses): We offer a 30-day warranty against manufacturing defects on the pump and fittings.
  • Chiller & Tub: These items are covered solely by the original manufacturer’s warranty. Temp Drop Labs will assist in facilitating communication with the manufacturer but does not provide a separate warranty for the chiller unit.
  • Returns: Due to hygiene reasons, we cannot accept returns on used tubs or tubing. Unopened Connection Kits may be returned within 30 days, subject to a restocking fee.

9. GOVERNING LAW These terms shall be governed by and construed in accordance with the laws of the State of Texas.
